Terms and Conditions for BetterWay Tutors

These Terms and Conditions ("Terms") govern your access to and use of the services provided by BetterWay Tutors ("Company"). By accessing or using our services, you agree to these Terms. If you do not agree, you must refrain from using our services.

1. Services Provided

BetterWay Tutors provides online, personalized tutoring sessions in math and English for students at various grade levels. Lessons are conducted virtually and tailored to individual needs.

2. Disclaimers

  • The Company does not guarantee specific academic results or improvements and is not liable for unmet expectations regarding academic performance.
  • The tutoring sessions are supplementary to school education, and responsibility for the student’s overall education remains with the parent or guardian.
  • The Company is not liable for any technical disruptions or interruptions in service caused by third-party platforms (e.g., Google Meet, Stripe) or customer equipment.

3. Limitation of Liability

  • To the fullest extent permitted by law, BetterWay Tutors is not liable for any direct, indirect, incidental, or consequential damages arising from the use of its services.
  • If liability is found, it will be limited to the amount paid for the specific session in question.

4. Payment Terms

  • Payment must be made at the time of booking or as part of an agreed-upon subscription plan.
  • Unsuccessful payments or chargebacks may result in the suspension of services.
  • All fees are non-refundable except as explicitly stated in Section 5.

5. Refund and Cancellation Policy

  • Refunds are provided only if the Company cancels a session and cannot reschedule.
  • Cancellations by the client must be made at least 24 hours before the session to qualify for rescheduling.
  • Missed sessions or cancellations made less than 24 hours in advance are non-refundable and non-transferable.

6. Rescheduling

  • Rescheduling requests must be submitted at least 24 hours in advance.
  • The Company reserves the right to reschedule sessions due to tutor availability, emergencies, or unforeseen circumstances.

7. User Responsibilities

  • Users must ensure their devices, internet connection, and required materials are functional before each session.
  • Parents or guardians are responsible for monitoring their child’s behavior during lessons. Disruptive behavior may result in session termination without refund.

8. Force Majeure

The Company is not responsible for delays or failures to perform due to events beyond its control, including natural disasters, technical disruptions, or acts of government.

9. Intellectual Property

  • All materials provided during tutoring sessions are the intellectual property of BetterWay Tutors.
  • Materials are for personal use only and may not be reproduced, distributed, or used for commercial purposes without written permission.

10. Privacy and Data Protection

  • The Company collects and processes personal information solely for service delivery purposes.
  • Payment details are processed securely through third-party payment processors (e.g., Stripe), and the Company does not store sensitive payment data.
  • By using our services, you consent to our collection and use of data as outlined in our Privacy Policy.

11. Indemnification

You agree to indemnify and hold harmless BetterWay Tutors, its employees, and contractors from any claims, liabilities, or expenses arising from your use of our services, including but not limited to:

  • Misrepresentation of information during booking.
  • Violation of these Terms or applicable laws.
  • Any disputes arising between you and a tutor.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Wyoming. Any disputes arising from the use of our services must be resolved exclusively in the courts of Wyoming.

13. Amendments

BetterWay Tutors reserves the right to modify these Terms at any time. Customers will be notified of changes via email or website updates, and continued use of services constitutes acceptance of the revised Terms.

14. Waiver of Liability for Minors

Parents or guardians enrolling minors in our services accept full responsibility for their child’s participation and agree to release the Company from liability for any issues arising during sessions.

15. Call Recording Consent

By submitting your information and using BetterWay Tutors’ services, you expressly consent to the recording of all telephone calls and communications with the Company, including those with sales and support representatives, for quality assurance, training, and compliance purposes.

You acknowledge and agree that notification or verbal announcement of call recording might not be provided at the time of the call. If you do not agree to the recording of calls, you must not submit your information or engage in any calls with BetterWay Tutors.
