The short version
- Your plan renews automatically every 4 weeks until you cancel. You can cancel online at any time, and the cancellation takes effect at the end of the 4 weeks you have already paid for.
- We record every lesson, video and audio, to prepare your child's lesson summary and practice, to keep quality high and to keep children safe. We ask for your consent before your child's first lesson.
- A parent or guardian is the account holder. We collect information about your child only with your permission, and you can review or delete it.
- We never sell your or your child's information.
- Tutors and students talk only in lessons and through our own channels. Tutors are not permitted to use personal phones or social media with students.
- How we handle your information is explained in our Privacy Policy, which forms part of these terms where applicable. Nothing in these terms limits privacy rights that cannot legally be waived.
This summary is for convenience. The full terms below are what apply.
1. Who we are
BetterWay Tutors is operated by BetterWay Tutors LLC ("BetterWay", "we", "us"). We provide online tutoring for students in kindergarten through grade 12.
2. Agreeing to these terms
These terms are an agreement between us and the parent or legal guardian who books or pays for our services ("you"). You must be at least 18 years old and the parent or legal guardian of each student you enroll, or authorized by them.
You accept these terms, and give the permissions in section 3, when you confirm a lesson (including the free trial), buy a plan, or take another action that clearly shows your agreement after being given these terms.
When you contact us or submit a form, you allow us to receive and answer your inquiry. That alone is not consent to marketing messages, to lesson recording, or to collecting your child's information; we ask for those as described in these terms and our Privacy Policy. Calls with our team are recorded only after we tell you, as described in section 10.
Our Privacy Policy and section 11 (calls, texts and emails) also describe how we handle information and messages from anyone who contacts us or submits a form, including before booking.
3. The permissions you give us
When you enroll a child and accept these terms, you give us each of the following permissions, for yourself and for each child you enroll, together with any further consent or verification the law requires:
- To contact you by phone call, text message, WhatsApp and email about your inquiry, the trial lesson, lessons, scheduling, payments and your account (section 11).
- To record calls with you, including sales calls before you become a customer, and to transcribe and analyze them, including with artificial-intelligence tools, to prepare for your child's lessons, train our team and improve our service (section 10).
- To record every lesson, including video, audio and the shared screen, and to transcribe and analyze the recordings, including with artificial-intelligence tools, to prepare summaries, practice and reports, review quality, train our tutors and keep children safe (section 10).
- To collect and use your child's information as described in our Privacy Policy. For a child under 13, we also ask you to confirm this permission as the child's parent or guardian before the first lesson.
- To keep and use your messages, voice notes and call recordings to serve you and improve our service (see our Privacy Policy).
- To send you marketing messages, such as offers and invitations to come back, but only if you agreed to marketing on our form or in writing. You can stop them at any time (section 11).
You can withdraw optional permissions, such as marketing, at any time, and doing so does not affect your lessons. If you withdraw a permission we need to provide recorded lessons or to handle essential student information, we may no longer be able to provide lessons, and any prepaid lessons are handled under section 8.
Students take part in lessons under your account and your supervision. Students do not enter into this agreement themselves, and you accept these terms on their behalf.
4. Our services
Our services may include live one-to-one online lessons, an assessment and academic report, lesson summaries, practice and homework, exam simulations, help between lessons, and, for families on a plan, a parent page where you can see lessons, manage your schedule and manage your plan.
A member of our team may join a lesson, such as the trial lesson, to observe or help.
Lessons take place in an online classroom run by a third-party provider. You are responsible for a working device, camera, microphone and internet connection, and for a quiet place where your child can take part.
We may change or improve our services over time. If a change materially reduces what your paid plan includes, we will tell you in advance, and you may cancel as described in section 7.
5. The free trial lesson
Your first lesson is free. It includes an assessment of where your child stands. We do not ask for your card for the trial, and nothing is charged automatically after it. A paid plan starts only if you choose one.
6. Plans, payment and automatic renewal
How plans work
Plans are sold in 4-week cycles. Each plan includes a set number of lessons per week, plus the summaries, practice and support described when you buy it. The plan, the number of lessons, the price and any family discount are shown to you before you pay.
Automatic renewal
When you buy a plan, it continues and renews automatically every 4 weeks until you cancel. At the start of each new 4-week cycle, we charge the payment method on file the plan price shown at checkout, plus any applicable tax. There is no minimum number of cycles. You can cancel at any time online from your parent page, as described in section 7.
Before you buy, we show you the amount and frequency of the recurring charge, what each cycle includes, and how to cancel, and we ask for your separate agreement to the automatic renewal. After you buy, we send you a confirmation by email or text with these terms, the price, how often you will be charged, and how to cancel. We also send renewal reminders as the law requires, including at least once a year.
Price changes
If we change the price of your plan, we will tell you at least 30 days before the new price applies. You may cancel before the new price applies and you will not be charged it.
Extra lessons
Extra lessons outside your plan are paid when you book them, at the price shown at booking.
Single lessons and packages
If you are on a single-lesson or package arrangement rather than a plan, the price and payment terms you agreed with our team apply.
Payment and failed payments
Payments are processed by our payment providers, such as card processors and bank-transfer services. We do not store full card numbers. If a payment fails, we will let you know and retry it. Lessons in a cycle that has not been paid are paused, and we hold your weekly time for 7 days so you can update your payment method. After that, your time may be released to another family.
If you dispute a charge with your bank, please contact us first; we can usually resolve it faster. Lessons may be paused while a dispute is open.
7. Cancelling or pausing your plan
You can cancel your plan at any time, online, from your parent page. You can also cancel by emailing [email protected] or texting +1 (855) 788-5384, including if your parent page is not working. Cancelling never requires you to answer questions, talk to anyone or accept another offer. We process your request promptly and confirm it by email or text.
A cancellation takes effect at the end of the 4-week cycle you have already paid for. You keep your remaining lessons in that cycle, and you will not be charged again.
You may also pause your plan for up to one cycle. While paused you are not charged and we hold your weekly time. Before the pause ends, we will ask you to resume or cancel. We do not restart charges without your action.
Before you cancel, we may ask one optional question about why. Answering is never required to cancel.
8. Refunds and credits
Payments for a 4-week cycle are generally not refundable after the cycle begins, except:
- if we cancel a lesson and cannot offer a reasonable make-up lesson or credit, we refund that lesson;
- if we end your plan without a material breach by you, we refund the unused part of the current cycle;
- if lessons cannot continue because you withdraw a consent needed for recorded lessons, we tell you how this affects your prepaid lessons and give any refund the law requires; and
- where the law otherwise requires a refund.
When a lesson is missed for a reason covered in section 9, we give you a make-up lesson or a credit toward future lessons. Credits have no cash value. Any other refund is at our discretion; to ask for one, contact us.
9. Scheduling, missed lessons and make-ups
- Your weekly time. Your plan includes a regular weekly lesson time with your tutor. You can change it from your parent page, subject to availability.
- Cancelling a lesson. If you cancel a lesson at least 24 hours before it starts, you receive a make-up credit, valid until the end of the following cycle. A lesson cancelled later than that, or missed without notice, counts as used.
- Joining late. If your child joins late, the lesson still ends at its scheduled time.
- If we cancel or the tutor misses a lesson, you receive a make-up lesson at a time that suits you, or a credit. If we cannot offer a reasonable make-up, you may ask for a refund for that lesson.
- If your tutor becomes unavailable for a longer period, we will offer you another tutor or a make-up arrangement.
- Lesson times are shown in the time zone stated in your confirmation. Please check that it is correct.
10. Lesson recording
We record every lesson, including video, audio and the shared screen. Everyone who takes part in a lesson is recorded, including your child, the tutor and any member of our team who joins.
Why we record
- to prepare your child's lesson summary, practice and progress reports;
- to check and improve lesson quality and to train our tutors;
- to keep children safe; and
- to resolve questions or disputes about a lesson.
How recordings are processed
We use service providers, including artificial-intelligence providers, to store, transcribe and analyze recordings, for the purposes described here and in our Privacy Policy, under the contracts and legal protections that apply to those services.
Your consent
Recording is a required part of our service, and we do not offer unrecorded lessons. Before your child's first lesson, including the free trial, we obtain your consent as the parent or legal guardian, and any verification the law requires.
A notice that the lesson is recorded appears when the lesson starts. Please avoid having anyone other than the enrolled student take part in a lesson without telling us. If someone else needs to take part, we obtain any consent the law requires before recording them.
You can withdraw your consent at any time by contacting us. Because lessons are always recorded, we will then stop providing lessons, and any prepaid lessons are handled under section 8.
We record and transcribe calls with our team, including sales calls before you become a customer, to prepare for your child's lessons, train our team and improve our service. At the start of each recorded call, before the conversation begins, we tell you that we record calls. By continuing the call, you agree to the recording. If you would rather not be recorded, tell us and we turn the recording off and continue without it.
Keeping and deleting recordings
How long we keep recordings, transcripts and other records is set out in our Privacy Policy. We delete them at the end of that period, unless we need to keep one longer to resolve a dispute, to protect a child or to comply with the law. You can ask us to delete your child's recordings sooner (see our Privacy Policy).
We may share a lesson's recording or summary with you as the parent. We never publish lesson recordings or use them in advertising without your separate written permission. We use automated transcription that separates who is speaking. We will tell you separately, and ask for any consent the law requires, before we collect or use any biometric identifier such as a voiceprint.
11. Calls, texts and emails
If you contact us about tutoring, we may answer you using the contact details you give us. If you become a customer, we send messages about your lessons, scheduling, payments and account.
We send marketing calls or texts, such as offers or invitations to come back, only when we have the consent the law requires, for example when you ticked the box on our form. Agreeing to marketing messages is never a condition of buying anything. We keep records of every consent and every request to stop.
- Message frequency varies. Message and data rates may apply.
- Reply STOP to stop texts and HELP for help. You can also unsubscribe from emails using the link in each email.
- We do not send marketing calls or texts before 9 a.m. or after 8 p.m. in your local time.
- A request to stop marketing, sent to any of our numbers or to any member of our team, stops marketing messages from all of them. Messages you need about lessons, scheduling and payments may continue where the law allows.
- Our marketing emails identify us, include our postal address and have a working unsubscribe link.
- We may also contact you on WhatsApp if you message us there or ask us to.
12. Safety and conduct
- Tutors and students communicate only during lessons and through BetterWay's own channels, which we can review. Our tutors are not permitted to contact students through personal phones, personal accounts or social media, and we ask that students and parents do not contact tutors that way either. Please tell us if it ever happens.
- A parent or responsible adult should be available nearby during lessons, especially for younger children.
- Everyone in a lesson is expected to behave respectfully. We may end a lesson, or end our services, if a student, parent or anyone present behaves in a way that is abusive, unsafe or inappropriate.
- If you have any concern about a child's safety or a tutor's behavior, contact us right away at [email protected]. We take every report seriously.
- We may share information with the authorities where the law requires it or a child's safety is at risk.
13. Our tutors
Our tutors are selected and trained by us, and they work with us as independent contractors. While you are enrolled, you agree not to knowingly arrange tutoring outside BetterWay with a tutor currently assigned to your child through BetterWay in order to avoid paying for services arranged by BetterWay. This does not apply to a tutoring relationship that existed before we introduced you.
14. Reviews and testimonials
You may choose to give us feedback or a review. Before we feature your review on our website or in advertising, we ask for your permission. If we use it, we keep its meaning, including in translation, and disclose any incentive or relationship where the law requires. We never require positive reviews or penalize negative ones, and you can ask us to stop using your review at any time.
15. Lesson materials
Lesson materials, worksheets, practice, summaries and reports we provide are for your child's personal learning only. You may not resell or publish them. The work your child creates belongs to your child.
16. No guarantee of results
We aim to help every student build skills and understanding, but results depend on many things, including the student's effort, attendance and school, so we cannot guarantee any particular grade, score or outcome. Our lessons support, and do not replace, your child's school.
17. Limits of liability
To the fullest extent the law allows, our services are provided "as is" and "as available", and we are not liable for indirect, incidental, special or consequential damages, or for interruptions caused by internet connections, devices or third-party platforms. For ordinary contract claims, our total liability is limited to the greater of $100 or the amount you paid us in the 12 months before the event giving rise to the claim.
These limits do not apply to liability that cannot lawfully be limited, including for fraud or willful misconduct, and nothing in these terms waives consumer rights that cannot be waived. Some states do not allow certain limits, so some of these may not apply to you.
18. Resolving disputes
Talk to us first. Before starting arbitration, either of us may describe the dispute to the other in writing, and we will try to resolve it within 30 days. This does not stop either of us from seeking urgent relief or using rights that cannot legally be delayed.
Arbitration. Except for claims that qualify for small-claims court and claims that the law does not allow to be sent to arbitration, any dispute arising from these terms or our services will be resolved by individual binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Fees are allocated under those rules and applicable law, and hearings may be held remotely. To the extent the law allows, arbitration proceeds only on an individual basis, not as a class or representative action, and you and we waive any right to a jury trial.
Opting out. You may opt out of this arbitration agreement within 30 days after you first accept these terms by emailing [email protected] with the subject "Arbitration opt-out", your name and the contact details on your account. Opting out does not affect your lessons or prices.
If part of this is unenforceable. If the ban on class or representative proceedings is found unenforceable for a claim, that claim proceeds in court, not in arbitration.
These terms are governed by the laws of the State of Wyoming, except where the law of your state of residence gives you protections that cannot be waived.
19. Changes to these terms
We may update these terms. We will post the new version here with a new date. If a change to these terms or to our Privacy Policy materially affects your plan, your price or your rights, we will tell you by email or text at least 30 days before it applies, and you may cancel before then. Otherwise, continuing to use our services after a change means you accept it.
20. General terms
- Events outside our control. We are not responsible for delays or failures caused by events we cannot reasonably control, such as outages, illness or natural disasters. We will offer make-ups where we can.
- Severability. If any part of these terms is found unenforceable, the rest stays in effect.
- Entire agreement. These terms, our Privacy Policy, and the plan details shown when you buy, are the whole agreement between us about our services.
- No waiver. If we do not enforce a term right away, we can still enforce it later.
- Assignment. You may not transfer your account without our consent. We may transfer these terms as part of a sale or reorganization of our business.
- Language. These terms are available in English and Russian. If the two versions differ, the English version applies, unless the law requires otherwise.
